October 1, 2009

In attendance:  PD, AP, JS, DC, MCas, MC and SF

PD stated the applicant is in attendance for his continuation on the request to amend the Special Permit for Air Quality that was issued in 2002 to Mr. Bevilaqua.  JS had procedural questions from the opening hearing as this was the first request before the ZBA to amend a Special Permit.  Town Counsel replied by email (read by JS) that the applicant would be continuing the same business and the request seemed straightforward. The applicant had Don DiCristofaro, Environmental Engineer in attendance to answer any questions regarding the environmental concerns with the air quality.  He stated the applicant has been in compliance since the permit was issued in 2002.  DEP does periodic testing and the plant has always been below the permitted amount. The applicant explained there is a bag test done every 30 days and these tests are required and will continue to be done.  The board questioned the hours of operation.  Attorney Antonellis explained that there may be more days of operation in the winter months but the use of asphalt in winter is much less as the additional owners will use the plant for emergency road work.  This will not affect the air quality in the winter months.

JS motion to grant to grant the applicants request for amendment of the special permit to include the Riley’s Brothers of Tuscan Street, Stoughton, MA.

Mr. and Mrs. Arcand were in attendance to request a five year renewal for the Special Permit for their family apartment that was issued in ?.  Mrs. Arcand stated that everything was the same as when the original permit was issued except that their mother passed away but their father, Fred Schiavone, is still living in the apartment.  JS explained to the applicants they needed to record the Special Permit at the Registry of Deeds showing Fred Schiavone as the occupant.  The applicants agreed.

The Board discussed the All Boards Meeting that was held on September 21st.  All the members were in attendance. It was noted that two or more members are not allowed to discuss any hearings outside of Public Hearing venue.  MC stated the minutes should now have more information in them to replace our current scaled down version.  DC inquired about the new 40B hearing that will be taking place and how it would work if a member had to miss a meeting.  It was explained that if there were no alternate members in place then the whole process would have to start over as it is important for the alternate members to be in attendance for all the hearings as they could possibly have to sit in as a voting member.
